1. Information We Collect
- Account Information: Your name, email address, and any optional information you provide, like a company name. We also process billing information through secure third-party payment providers like Stripe.
- Your Training Data: The datasets, configurations, and models you upload or create on our platform. Your data is yours, and we only process it to provide our service to you.
- Usage Information: Data about how you use our platform, such as GPU hours consumed, features used, and technical data like your IP address, browser type, and operating system. We use this to improve our service and ensure security.
2. How We Use Your Information
- To Provide the Service: To run your training jobs, manage your account, process payments, and provide customer support.
- To Improve the Service: We analyze anonymized usage patterns to identify bugs, optimize performance, and develop new features.
- For Security and Compliance: To prevent fraud, enforce our Terms of Service, and comply with legal obligations.
3. Data Sharing and Third Parties
We do not sell your personal information or training data. We only share information with trusted service providers under strict confidentiality agreements for essential functions, such as:
- Payment processing (e.g., Stripe)
- Cloud hosting and storage providers
- AI processing providers, including Google for Gemini Omni video generation and editing
- Analytics tools to improve our product
We require these partners to follow strong data protection practices.
4. Data Retention
- We retain your training data and generated assets for as long as your subscription is active (see Data Retention in Terms of Service).
- If you cancel your subscription, we retain generated images and videos for 90 days. LoRA models, if available on your plan, are also retained for 90 days, unless you request earlier deletion.
- For Gemini Omni video requests, Google may retain the stored Interaction used for generation and conversational editing for up to our configured 55-day retention window.
- Video files temporarily uploaded to Google for Gemini Omni processing are automatically deleted by Google after approximately 48 hours. HummingBytes does not explicitly delete these temporary production Files in this version of the service.
- When you delete a Gemini Omni video from HummingBytes, we first delete the selected stored asset and then make one best-effort attempt to delete the Google Interactions accepted for that video's generation task. A Google cleanup failure does not reverse deletion of the HummingBytes asset.
- Deleting one video does not delete independently retained descendant videos or their Interactions. A surviving descendant may retain conversational context derived from a deleted ancestor until the descendant is deleted or Google's 55-day Interaction retention window expires.
- Whole-account deletion and the rare case in which best-effort Interaction cleanup fails rely on Google's automatic expiry. Deleting a HummingBytes asset therefore does not guarantee immediate erasure of context retained in an independently surviving descendant.
5. Your Rights
Depending on your location, you may have the right to:
- Access, correct, or delete your personal data.
- Object to or restrict certain processing.
- Request data portability.
- Withdraw consent for optional processing (e.g., analytics cookies).
