Our privacy policy and how we use your data

At HummingBytes, LLC (“we,” “us”), we are committed to protecting your privacy. This policy explains what information we collect, how we use it, and your rights regarding your data.

1. Information We Collect

  • Account Information: Your name, email address, and any optional information you provide, like a company name. We also process billing information through secure third-party payment providers like Stripe.
  • Your Training Data: The datasets, configurations, and models you upload or create on our platform. Your data is yours, and we only process it to provide our service to you.
  • Usage Information: Data about how you use our platform, such as GPU hours consumed, features used, and technical data like your IP address, browser type, and operating system. We use this to improve our service and ensure security.

2. How We Use Your Information

  • To Provide the Service: To run your training jobs, manage your account, process payments, and provide customer support.
  • To Improve the Service: We analyze anonymized usage patterns to identify bugs, optimize performance, and develop new features.
  • For Security and Compliance: To prevent fraud, enforce our Terms of Service, and comply with legal obligations.

3. Data Sharing and Third Parties

We do not sell your personal information or training data. We only share information with trusted service providers under strict confidentiality agreements for essential functions, such as:

  • Cloud Providers (e.g., AWS, Google Cloud): For computing power and storage.
  • Payment Processors (e.g., Stripe): To handle payments securely.
  • Authentication Services (e.g., Supabase): To manage user logins.

We may also disclose information if required by law, such as in response to a subpoena, court order, or government request.

4. Your Privacy Rights

We extend global privacy rights to all our users. You have the right to:

  • Access: Request a copy of the personal information we hold about you.
  • Correct: Update or correct any inaccurate information.
  • Delete: Request the deletion of your account and personal data.
  • Portability: Export your data and model weights from the platform.
  • Opt-Out: Unsubscribe from marketing communications and manage your cookie preferences.

5. Data Security and Retention

We take security seriously. We use industry-standard security measures, including encryption (AES-256 for data at rest, TLS for data in transit), access controls, and regular security audits to protect your data. Your training data is isolated and is never used to train models for other users. In the event of a data breach that affects your personal information, we will notify you within 72 hours of discovery, as required by applicable law.

We retain your data as long as your account has an active subscription. When your subscription ends or is cancelled:

  • Generated Images & Videos: Retained for 30 days after subscription ends, then permanently deleted.
  • LoRA Models: Retained for 90 days after subscription ends (due to their higher training cost), then permanently deleted.
  • Account Data: Basic account information may be retained for up to 6 months for security and legal compliance purposes.

We will send email reminders before any data deletion occurs. Active subscribers enjoy unlimited storage for all their content.

6. Children's Privacy

Our platform is not intended for individuals under 18. We do not knowingly collect data from children.

7. International Data Transfers

Our services are hosted in the United States. If you are using our platform from another region, your information will be transferred to the U.S. We use appropriate legal mechanisms, like Standard Contractual Clauses, to ensure your data is protected.

8. AI and Automated Decision-Making

We use automated systems to analyze usage data for the purpose of improving our platform and for security monitoring. These systems do not make automated decisions that would have a legal or otherwise significant effect on you.

We may update this policy occasionally. We will notify you of significant changes via email or a platform notice.
